Kindly note the following terms and conditions of this sale. Elegant Fine Wine (HK) Ltd. will be referred to as EFW hereinafter.
1. Privacy policy.
EFW only collects and retains information that are significant in processing your orders. Personal information such as your name, phone number, email address and delivery address will be required from you as that will help us to contact and schedule the delivery to you. The information collected will only be used for such purpose and will not be shared to any third party services or to the public.
2. Delivery policy.
We provide customers with the option of door-to-door delivery or self pick up! Orders below HK$3,000 and below will be subjected to an additional delivery fee. The fee will be based on your order amount and delivery area.
For door to door deliveries, payment will need to be made in full unless customer opt for Cash on Delivery. Do note that we do not accept cheques for order on Cash on delivery
Delivery will be scheduled within 2-3 days once payment has been confirmed received. We deliver from Mondays to Fridays, 11am to 5pm. There will be no deliveries scheduled on the weekends and on Public Holidays.
3. Returns policy.
We do not accept returns once a transaction have been completed. If you find that any bottle have been damaged, tempered with, and/or opened, at the time of delivery or pick up, kindly inform us immediately of any such discrepancies.
General Terms and Conditions of Sales
4. Prices.
All transactions are conducted in Hong Kong Dollars.
5. Trade sales.
All wines sold are delivered ex-Hong Kong only.
6. Delivery.
EFWHK provides the option of door-to-door delivery or self pick up. Orders below HK$3,000.00 will be subjected to an additional delivery fee. The fee will be based on your order amount and delivery area.
For door to door deliveries, full payment of the order will be required prior to delivery unless you opt for the 'Cash on Delivery' method. Do note that we do not accept cheques as cash for the cash on delivery method.
Deliveries will be scheduled within 3 days once the full payment has been confirmed. We schedule deliveries from Mondays to Fridays, 11am to 5pm; subject to a confirmation and prior engagements. There will be no deliveries on weekends and public holidays. Self pick up can be done at the same said times, at our office premises.
7. Payment.
(a) Full payment is required for all orders unless you are afforded a trade account with EFW.
(b) Pre-Orders.
(i) A 10% deposit will be required for all confirmed pre-orders. The balance amount must be settled within 1 week upon notification of arrival of goods ordered.
(ii) In the event of non-payment of amount due within the specified terms, EFW reserves the right to charge a cancellation fee of up to 20% of the outstanding amount, or actual losses incurred by EFW reserves the right to utilize any monies held on account or otherwise received from or on behalf of the customer to discharge any such cancellation fees.
(iii) EFW shall be entitled to charge interest on unpaid invoices at 8% over the Hong Kong Monetary Authority approved base rate from the date payment the was due.
(iv) EFW shall be entitled to sell any wines which it is holding or storing on behalf of a customer to discharge outstanding invoices (whether on account of cancellation fees, interest or otherwise). EFW will account to the customer for any cash balance held after discharging all outstanding invoices.
8. Ownership.
Ownership to all wines shall remain with EFW until all sums due from the buyer is paid in full.
9. Collection / Delivery of Pre-Ordered Wines.
You will be required to pay the balance of the total amount owed for the pre-order within 7 days upon being notified of the goods' arrival. Once the payment have been confirmed and cleared, the goods will then be delivered to the location of your choice, ex-Hong Kong.
Failure to make the required payment within the stipulated time frame will compel us to invoke and exercise point number 7(b)(ii).
10. Quality Control.
EFW makes every effort to ensure that all wines we sell are of impeccable quality and in a condition appropriate for the age of the wine, including thorough provenance checks, physical inspections and appropriate storage conditions.
In the event that the wines are corked or out of condition for consumption, EFW will be under no obligation to offer replacements or offer other compensation of any kind and such replacements or compensation will be made entirely at our discretion.
We cannot guarantee that wines will always show at their best. Regardless of reputation, all wines can age and mature in different ways and we will not bear any liability for subjective judgments such as quality or drinkability. All older bottles are therefore sold as seen and we cannot accept returns for any wines should they be corked, tainted or fatigued in any way.
It is also highly recommended that the older the wine, the longer the time that should be allowed for preparation before serving. Wines benefit from rest as well as being stood up for a number of days before opening and drinking.
NOTE : Please be aware that wines may be inspected on arrival at port for Customs purposes and EFW cannot guarantee that the packaging of your wines will be free of signs of tampering.
11. Force Majeure.
EFW will not be liable for failure to meet agreed obligations due to prevailing circumstances beyond our reasonable control, which include forces of nature and civil commotions.
12. Jurisdiction.
This contract is subject to the laws of Hong Kong and jurisdiction. All wines are offered subject to market movement and remaining unsold.
13. Duties and Taxes.
There are no applicable import duties and taxes of any kind in Hong Kong, in relation to wines.
If the shipment is re-routed outside of Hong Kong, EFW is not responsible for these charges and we undertake to make no calculations or estimates in this regard. We recognize that if you are shipping internationally, the process can be complex and EFW will be on hand to guide you with advice and support and/or put you in contact with a suitable freight forwarder.
14. General.
(a) EFW reserves the right to alter these terms and conditions at any time.
(b) If any provision of these terms and conditions are held to be or made invalid by a competent court of jurisdiction's decision, statute, rule or otherwise, the remainder of these terms and conditions shall not be affected thereby.
(c) EFW will not be liable for any failure to meet our obligations occasioned by circumstances beyond our reasonable control.
(d) These terms and conditions shall be governed by the laws of Hong Kong and you agree that the courts of Hong Kong shall have exclusive jurisdiction in relation to any dispute or claim concerning these terms and conditions.
